DirecTV seeks relief against defendants’ possession and/or use of devices purchased from “USA CardCleaner,” a company DirecTV alleges provides services “primarily designed for the surreptitious interception of satellite communications broadcast by DirecTV.” Various Texan consumers are joined in this lawsuit. DirecTV accuses defendants of violating 47 U.S.C. § 605 by effecting unauthorized interception through use of “illegal satellite devices” or through manipulation of an authorized satellite system. DirecTV claims defendants also intentionally intercepted or endeavored to intercept signal, amounting to a violation of 18 U.S.C. §2511. DirecTV’s third and fourth claims—based on 18 U.S.C. § 2512 and 47 U.S.C. § 605, respectively--allege that defendants possessed, manufactured, manipulated, or assembled a device that is primarily useful for the surreptitious interception of satellite signals. DirecTV also alleges defendants wrongfully converted DirecTV’s propriety interests for their own benefit. Finally, DirecTV asserts defendants violated Tex. Civ. Prac. & Rem. Code § 123.001 by using devices to intercept signal, “constituting an extraordinary use of satellite and television viewing equipment.”
